Welcome to Afli.ae. These Terms and Conditions ("Terms") govern your use of our website afli.ae and all related services, including our AI Website Builder, AI E-commerce store builder (each comparable to website and e-commerce hosting platforms such as Wix and Shopify), domain registration and management, subscriptions, wallet, CRM, and other AI-powered tools (the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

1. Nature of Service — We Are a Platform and Hosting Provider

Afli.ae provides a platform that allows users to create, build, and host websites and e-commerce stores. We provide the technology, hosting, and tools; we do not create, control, or endorse the content, products, or activities of users. We act solely as a hosting and platform provider. Any website or online store that you create, publish, or operate using our Services is your website or store. You are the operator and responsible party for that site or store and for all content, products, and activities on it. We are not a party to any transaction between you and your customers or visitors, and we do not assume any responsibility or liability for the conduct of users, the content they upload, or the activities that occur on or through user-hosted websites or stores.

2. User Content and User Responsibility — You Are Solely Responsible

You are solely and entirely responsible for all content, data, materials, products, and information that you upload, publish, display, distribute, or make available through our Services or through any website or e-commerce store hosted on our platform ("User Content"). This includes, without limitation:

• Text, images, graphics, videos, audio, and any other media;
• Product listings, descriptions, and pricing on your e-commerce store;
• Any goods or services you offer for sale and the legality, accuracy, and quality of such offerings;
• Communications with your customers or visitors;
• Compliance with consumer protection, advertising, tax, and data protection laws applicable to your business.

We do not monitor, review, or assume any responsibility for User Content. We do not endorse, verify, or guarantee the accuracy, legality, or quality of any User Content. Any use of our Services to host or publish content is at your own risk. You represent and warrant that you have all necessary rights to use and publish your User Content and that your User Content and your activities do not violate any law or any third party's rights. We are not responsible for any loss, damage, or liability arising from User Content or from the activities of you or your end users on websites or stores hosted with us.

3. Prohibited Content and Activities

You may use our Services only for lawful purposes. You agree not to upload, publish, or facilitate any content or activity that:

• Violates any applicable law, regulation, or third-party right (including intellectual property, privacy, or publicity rights);
• Is defamatory, fraudulent, misleading, obscene, harassing, or promotes violence or discrimination;
• Constitutes or facilitates illegal activity, including the sale of prohibited or restricted goods or services;
• Contains malware, spam, or other harmful or disruptive code;
• Attempts to gain unauthorized access to our systems, other accounts, or any third-party systems;
• Otherwise breaches these Terms or is harmful to us, other users, or third parties.

We may remove or disable access to any User Content, and suspend or terminate your account or hosting, if we reasonably believe you have breached these Terms or if required by law. We are not liable to you or any third party for any such removal, suspension, or termination.

4. No Responsibility for User Activities or Third-Party Claims

To the fullest extent permitted by law, Afli.ae and its affiliates, officers, directors, employees, and agents shall not be responsible or liable for:

• Any User Content or the accuracy, legality, or quality of User Content;
• Any activities conducted by you or by visitors or customers on your website or e-commerce store;
• Any transactions between you and your customers or between users;
• Any claims, disputes, or damages arising from User Content, user conduct, or from websites or stores hosted on our platform;
• Your compliance (or non-compliance) with laws applicable to your business, including tax, consumer protection, data protection, and advertising laws;
• Any loss or harm suffered by you, your customers, or any third party as a result of User Content or user activities.

You assume all risk associated with your use of the Services and with the operation of your website or e-commerce store. We provide the platform and hosting only; we do not control, endorse, or take responsibility for what users upload or how they use their hosted sites or stores.

5. Reporting Abuse and Takedown

If you believe that content hosted on our platform infringes your rights or violates applicable law, you may report it to us at info@afli.ae with sufficient detail to identify the content and the basis for your report. We may remove or disable access to content in accordance with our policies and applicable law. We do not guarantee any particular outcome and are not liable for any decision to remove or not remove content. Users who repeatedly post infringing or prohibited content may have their accounts suspended or terminated.

6. Eligibility and Account

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete registration and billing information.

7. Subscriptions, Payments, and Refunds

Fees for subscriptions, domains, SSL, add-ons, and other paid features are as displayed at the time of purchase. You authorize us (and our payment processors, e.g. Stripe) to charge your chosen payment method. Subscription fees may recur (e.g. monthly or yearly) until you cancel. Refund and cancellation policies are as stated on the relevant product or checkout pages; we are not obliged to refund fees except as required by law or as explicitly stated in our refund policy.

8. Domains and Hosting

Domain registration and renewal are subject to the policies of the relevant registrars and registries. We do not guarantee the availability of any domain name. You are responsible for renewing domains and for any loss of a domain due to non-renewal. Hosting and publishing of websites and e-commerce stores are provided according to your subscription; we may impose reasonable limits on use and may suspend or terminate hosting for abuse, non-payment, or violation of these Terms.

9. Intellectual Property

We grant you a limited, non-exclusive, non-transferable license to use our Services in accordance with these Terms. You retain ownership of User Content you create or upload. By using our Services, you grant us the rights necessary to operate the Services (e.g. to host, display, store, and back up your content). Our trademarks, logos, and the look and feel of our platform remain our property.

10. Disclaimers

Our Services are provided "as is" and "as available." We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. We disclaim all warranties, express or implied, to the maximum extent permitted by law. We are not liable for any loss or damage arising from your use of the Services, from User Content, from the conduct of you or your customers, or from third-party services (e.g. payment gateways, domain registrars). You use the Services and host your website or store at your own risk.

11. Limitation of Liability

To the maximum extent permitted by law, Afli.ae and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising from or related to your use of the Services, your User Content, your website or e-commerce store, or the activities of you or your end users. Our total liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Afli.ae and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services; (b) your User Content; (c) your website or e-commerce store and any products or services you offer; (d) any activities conducted by you or by visitors or customers on your hosted site or store; (e) any breach of these Terms or any law by you; or (f) any claim by a third party (including your customers) arising from your content, your conduct, or your operation of your website or store. This indemnification obligation survives termination of your account and these Terms.

13. Changes to Terms and Services

We may modify these Terms or the Services at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after such changes constitutes acceptance of the new Terms. If you do not agree, you must stop using the Services and may cancel your account or subscriptions as applicable.

14. Governing Law and Disputes

These Terms shall be governed by the laws of the United Arab Emirates. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE, unless otherwise required by mandatory law.

15. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and Afli.ae regarding the Services.
